This Privacy Policy describes how Duration Capital Partners LLC (“Duration”, “we”, “us”, “our”) collects, uses and discloses information about you when you use our website (www.durationcapitalpartners.com), applications, services, tools and features, or otherwise interact with us (collectively, the “Services”). For the purpose of this Privacy Policy, Duration is the data controller for your information, and “you” and “your” means you as the user of the Services. Please read this Privacy Policy carefully. By using any of the Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not use or access the Services.

If you are an investor with any account, investment fund or similar vehicle managed and/or advised by Duration, the data we collect about you in that capacity is subject to our Investor Privacy Notice, which will be made available to you separately.

Changes to this Privacy Policy

We may modify this Privacy Policy, in which case we will update the “Last Revised” date. If we make material changes to the way we use information we collect, we will use commercially reasonable efforts to notify you and will take additional steps as required by applicable law. If you do not agree to any updates to this Privacy Policy, please do not use or access any of the Services.

Collection and Use of Information

When you use or access the Services, we collect certain information about you from different sources. 

Information You Provide to Us

Some features of the Services may require you to directly provide certain information. You may elect not to provide this information but doing so may prevent you from using or accessing these features. Information that you directly submit through our Services includes:

  • Contact information, such as your name and email address.
  • Job applicant details, such as information included in your resume of CV, references, job history, and other information collected as part of evaluating your candidacy and processing your application for employment.
  • Any other information you choose to provide, including information provided in communications with us or when interacting with our website’s webforms. 

 

Information Collected Automatically

We, and third parties on our behalf, may automatically collect certain information about your interactions with the Services and emails, including through cookies and other tracking technologies (“Tracking Technologies”). We collect and use this information to tailor your experience with the Services, run analytics, de-bug, and better understand user interactions with and improve the Services. We may associate this information with the device you use to access the Services, or email accounts you use to engage with us. 

Such information includes:

  • Device information, such as device type, operating system, screen size, unique device identifier, Internet protocol (IP) address, preferred language and browser information.
  • Location information, such as approximate location.
  • Other information regarding your interaction with the Services, such as browser type, log data, date and time stamps, emails you have opened and clickstream data (e.g., page requests, page views, how much time is spent on a page, content viewed or interacted with, text entered, etc.).

Information We Obtain from Third Parties 

Finally, we may obtain information about you from third parties, including: 

  • Career websites, such as LinkedIn, Monster, or Indeed. 
  • Referees and other third parties whom you authorize to provide us with information. 

We may also use any of the information described in this section to communicate with you (including about Duration and/or our investment funds), provide and improve the Services, manage our relationship with you, monitor and analyze trends, conduct internal research and development, manage our business and funds’ investments, process any application for employment, comply with applicable legal obligations, enforce any applicable terms of service, and to protect the Services, our rights, and the rights of our users, investors or others.

Disclosure of Information

We may disclose your information for legitimate purposes subject to this Privacy Policy, including with: 

  • Vendors or other service providers who help us provide the Services, including for cloud storage, system administration, security, customer relationship management, marketing communications, data analytics and the deployment of Tracking Technologies. 
  • Our affiliates or others within our corporate group.
  • Professional advisors, such as auditors, law firms and accounting firms.
  • Transaction parties, in connection with or anticipation of an asset ale, merger, bankruptcy or other business transaction.
  • Other third parties to comply with applicable law or any obligations thereunder, to comply with applicable terms of service, to ensure the safety of the Company, its users and/or investors, or when you request or direct us to share information.

Cookies and Other Tracking Technologies

We use Tracking Technologies to collect information about your browsing activities, including your browsing over time and across different websites following your use of our Services. Most browsers accept Tracking Technologies automatically, but you may be able to control the way in which your devices permit the use of Tracking Technologies. If you so choose, you may block or delete certain Tracking Technologies from your browser; however, blocking or deleting Tracking Technologies may cause some of the Services, including login features and general functionality, to work incorrectly. 

Your browser settings may also allow you to transmit a “Do Not Track”, “opt-out preference” signal or other mechanism for exercising your choices regarding the collection of your information when you visit various websites. Like many websites, our website is not designed to respond to such signals and we do not use or disclose your information in any way that would legally require us to recognize opt-out preference signals. We may provide links to third-party websites or platforms, and display, or make available content, data, applications or materials from third parties. We are not responsible for the privacy or security of, or information found on, these sites, or the accuracy, completeness or reliability of third-party materials. Information you provide on public or semi-public venues, such as third-party social networking platforms, may be viewable by other users of the Services and / or users of those third-party platforms without limitation as to its use. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators.

Children’s Privacy

Our Services are not intended for children, and we do not seek or knowingly collect any personal information from children. If we become aware that we have unknowingly collected information from a child, in particular children under 13 years of age, we will make commercially reasonable efforts to delete such information from our database. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the below information to request that it be deleted.

Data Security and Retention

Please note that any information you send to us electronically, while using the Services or otherwise interacting with us, may not be secure while in transit. We recommend that you do not use unsecure channels to send us sensitive or confidential information. Despite our reasonable efforts, no security measures are impenetrable, and we cannot guarantee “perfect security.” 

We retain your information for as long as is reasonably necessary for the purposes specified in this Privacy Policy. When determining the length of time to retain information, we consider various criteria, including whether we need the information to continue to administer your account, provide the Services, resolve a dispute, enforce our contractual agreements, prevent harm, promote safety, security and integrity, or protect ourselves, including our rights, property or products.

This section applies if you are a resident of California. For purposes of this section, references to “personal information” shall also include “sensitive personal information” as those terms are defined under the CCPA.

We only use and disclose sensitive personal information for the purposes specified in the CCPA or otherwise in line with your consent. 

We do not “sell” or “share” (as those terms are defined under the CCPA) personal information, nor have we done so in the preceding 12 months. Further, we do not have actual knowledge that we sell or share personal information of residents under 16 years of age. 

Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, and may apply only in certain circumstances. 

  • Right to Access / Know. You may have a right to request access to personal information that we hold about you, including details relating to the ways in which we use and share your personal information, or the ways in which your personal information has or may have been used or disclosed by us in the past. 
  • Right to Delete. You may have a right to request that we delete personal information we maintain about you. 
  • Right to Correct. You may have a right to request that we correct inaccurate personal information we maintain about you.

We will not discriminate against you for exercising any of these rights. Further information may be needed to verify your identity before exercising these rights, such as your email address or government issued ID. You may designate, in writing or through a power of attorney document, an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. 

You may also opt out of marketing emails using the opt-out or “unsubscribe” instructions provided in the email. However, after opting out you may still receive transactional emails from us such as emails about your account.
